After evidentiary hearing by ALJ for Department of Healthcare and Family Services, court affirmed Department's decision to deny Plaintiff physician's application for reinstatement from suspension as a Medicaid provider and to recover and withhold payment for services Plaintiff rendered during his suspension. In 2014, Department had suspended Plaintiff for 1 year. Department and its ALJ and Director did not exceed their authority in effectively treating the 2014 suspension as an "at least one year" suspension. ALJ did not err in admitting as evidence in Department hearing the exhibits generated by Department employee whose testimony laid an ample foundation that Department keeps claims data in computer system in ordinary course of its business overseeing Medicaid program. Director's decision was not clearly erroneous.(MIKVA and GRIFFIN, concurring.)
