Department of Financial and Professional Regulation suspended Plaintiff's podiatrist license for at least 5 years for "unprofessional conduct" . Department's complaint was timely filed within 5 years of when Department learned of alleged conduct or violation. Ground for suspension was dishonorable, unethical or unprofessional conduct likely to deceive, defraud or harm the public, which is exempted from the 10-year statute of repose time limit. Defendant had been convicted of felony of mail fraud and criminal forfeiture, which were code of ethics violations. Indiana Board had suspended Plaintiff from practice indefinitely, for a minium of 60 years. Expert testimony explaining standard for unprofessional conduct was unnecessary because Department rules already define those standards. (PIERCE and COGHLAN, concurring.)
