Gibbons v. OSF Healthcare System

Plaintiff filed an action alleging false imprisonment, assault, and medical battery. The plaintiff settled with hospital defendant, leaving only a false imprisonment claim against a defendant doctor. Plaintiff and defendant filed cross-motions for summary judgment. The trial court granted defendant’s motion for summary judgment and plaintiff appealed. The appellate court affirmed finding plaintiff did not establish that defendant doctor restrained her or that he failed to conform with the Mental Health Code relating to involuntary admissions and, as a result, his actions in treating plaintiff were not unlawful.
