In re Marriage of Jones

Respondent appealed a trial court order granting in part and denying in part respondent’s motion to dismiss petitioner’s rule to show cause petition by arguing that the trial court erred in finding an evidentiary hearing was required to determine the motion brought under section 2-615. The appellate court affirmed the denial of the motion finding that the petition did not fail to state a claim on which relief could be granted. The appellate court further vacated the trial court’s severance of certain provisions from the language of an agreed order. (BOIE and MOORE, concurring)
