ISBA Statehouse Review for the week of July 21, 2016

ISBA Director of Legislative Affairs Jim Covington reviews legislation in Springfield of interest to ISBA members. This week he covers Common Interest Community Association Act and the Condominium Property Act Public Act 99-569, Common Interest Community Association Act and the Condominium Property Act. Public Act 99-567Illinois Human Rights Act. Public Act 99-548, Uniform Disposition of Unclaimed Property Act. Public Act 99-577, Property Tax Code Public Act 99-579 and Alcoholism and other Drug Abuse and Dependency Act Public Act 99-574.

Common Interest Community Association Act and the Condominium Property Act. Public Act 99-569 (Mulroe, D-Chicago; Martwick, D-Chicago) provides that any assignment of a developer’s interest in the property is not effective until the successor obtains the assignment in writing and records it. Effective January 1, 2017.

Common Interest Community Association Act and the Condominium Property Act. Public Act 99-567 (Haine, D-Alton; Martwick, D-Chicago) allows a board to close any portion of a noticed meeting or meet separately from a noticed meeting to do the following: (1) “Discuss” instead of “consider” appointment, employment, engagement, or dismissal of an employee, independent contractor, agent, or other provider of goods and services. (2) Interview a potential employee, independent contractor, agent, or other provider of goods and services. (3) Consult with the association’s legal counsel. Effective January 1, 2017.

Illinois Human Rights Act. Public Act 99-548 (Hernandez, D-Cicero; Martinez, D-Chicago) increases the amount of civil penalties for civil rights violations in real estate transactions. Effective January 1, 2017.

Uniform Disposition of Unclaimed Property Act. Public Act 99-577  (Link, D-Gurnee; Jackson, D- E. St. Louis) reduces from seven to five years before unclaimed property held by the government or court is considered to be abandoned. Effective January 1, 2017.

Property Tax Code. Public Act 99-579 (McGuire, D-Crest Hill; Fortner, R-West Chicago) allows a board of review to serve by electronic means if the taxing district consents to electronic service and provides the board of review with a valid e-mail address for this purpose if a change in assessed valuation of $100,000 or more is sought. Effective July 15, 2016.

Alcoholism and other Drug Abuse and Dependency Act. Public Act 99-574 (Hunter, D-Chicago; Harper, D-Chicago) If a person has successfully completed alcohol or drug addiction treatment as a condition of probation and qualifies for a vacation of the judgment of conviction, he or she must file a motion to vacate the judgment at any time from the date of the entry of the judgment to a date that is not more than 60 days after the discharge of the probation (rather than within 30 days of the entry of the judgment). Effective January 1, 2017.
