Fair Labor Standards Act
In action by plaintiffs-employees under Fair Labor Standards Act alleging that defendant-employer wrongfully failed to compensate them for their time spent walking to and from locker room at beginning and ending of their shifts, Dist. Ct. erred in finding that said "travel time" may be compensable. Defendant and union agreed that clothes-changing activities that occurred in locker room were not compensable under collective bargaining agreement, and thus, said travel time to and from locker room was exempt under section 254(a) of Postal-to-Postal Act and FLSA, since: (1) clothes-changing activities could not be viewed as principal employment activities where they were not compensable under collective bargaining agreement; and (2) plaintiffs could not make required showing that instant travel occurred between two separate principal employment activities.
