2012 IL App (4th) 110992
Decision Date:
August 22, 2012
District:
4th Dist.
Division/County:
Vermilion Co.
Justice:
TURNER
Holding:
Reversed and remanded with directions.
Plaintiff sued for injuries sustained from slip and fall on ice at gas station; jury awarded damages of nearly $500,000 but reduced by 25% for Plaintiff's negligence. Snowfall created natural accumulation in Defendant's parking lot, independent contractor plowed lot, and employee put salt down on metal plates. Thus, facts fall under natural accumulation rule, even if plowing and salting resulted in melting and later re-freezing. (APPLETON and KNECHT, concurring.)
