Plaintiff, a painter at construction site, sued for injuries from fall from scissor lift. Genuine issue of material fact as to whether removal of guard gate of scissor lift, which was designed to prevent falls, was reasonably foreseeable. Removal of gate required only the removal of a nut and bolt and two pins; no evidence of special expertise needed to remove gate. (BOWMAN and BURKE, concurring.)
