Turk v. Turk

Illinois Supreme Court PLAs
Civil Court
Child Support

PLA issue Date:

Docket Number:
No. 116730
District:
1st Dist.
This case presents question as to whether trial court properly directed ex-husband, who had sole custody of parties’ child, to pay ex-wife $600 per month in child support, where record showed that ex-wife had equally shared possession of child, and where ex-husband earned approximately $150,000 per year while ex-wife earned less than $10,000. Appellate Court, in reversing trial court, found that although trial court had authority to direct ex-husband to pay child support under instant circumstances, remand was required where amount awarded to wife was not supported by record. In his petition for leave to appeal, ex-husband argued that section 505 of Illinois Marriage and Dissolution of Marriage Act precluded trial court from awarding any child support to ex-wife as non-custodial parent, and that trial court abused its discretion in requiring him to pay for all uncovered medical expenses of child in addition to paying said child support.
