Dist. Ct. erred in granting defendant-employer’s motion for summary judgment in Title VII action alleging that defendant terminated plaintiff for alleged intimidation of co-workers and residents of homeless shelter in retaliation for having filed second EEOC charge of discrimination against defendant. While defendant asserted that decision to terminate plaintiff was made five days prior to receiving notice of EEOC charge, record showed that plaintiff was terminated one day after supervisor had become aware of EEOC charge, and defendant produced no documentation that termination decision was made at earlier time. Moreover, defendant offered no evidence to explain why it waited six days to actually terminate plaintiff if in fact termination decision had occurred at that time.
