Defendant Review Board issued Plaintiff a permit to build ambulatory surgical center. Seven years after construction was finished and IDPH had issued Plaintiff license to operate it, Defendant notified Plaintiff of its intent to fine Plaintiff based on unauthorized cost overrun in construction, and Plaintiff's failure to respond to request for information about cost overrun. Review Board has authority, under Section 14.1 of Health Facilities Planning Act, to impose discipline on permit holders even after completion of construction, and after issuance of license, where violations of Act are not discovered until after licensure.
