Petitioner filed for writ of certiorari, seeking review of CTA Board's decision upholding his termination based on alleged violation of CTA ordinance requiring certain employees to reside within a specified service area. Evidence established that Petitioner was living in temporary residence to comply with residency requirement, while looking for a permanent home there, which was sufficient to establish new domicile. His uncontradicted testimony showed that he intended to permanently abandon his home which was outside service area, and to make permanent residence in service area. Board and Court erred in finding that he did not meet residency requirement of CTA ordinance. (NEVILLE and LIU, concurring.)
