Plaintiff company entered into two nearly identical settlement agreements with two insurers, as to Plaintiff's being named in several suits by private parties in Arizona for injuries relating to its disposal of hazardous substances in Phoenix area. Dispute over whether agreements contain provisions that operated to release Defendants from providing insurance coverage for certain claims against Plaintiff. Court properly denied Defendants' motions for summary judgment and concluded that parties had not released Plaintiff's claims, as the term "environmental as used in release controls scope of release and is ambiguous.
