In consolidated election cases, petitioner sought review of respondent’s order overruling his objection to signatures collected for non-partisan candidates for the Chicago Board of Education’s school board. The principal issue on appeal was whether the board erred in concluding that the candidates’ circulators did not violate the Election Code’s prohibition on dual circulation by gathering signatures for the non-partisan candidates after circulating petitions on behalf of partisan candidates in the primary election. The appellate court affirmed, finding that the plain language of the dual circulation prohibition as well as its purpose was not implicated in a non-partisan election where candidates do not identify a political affiliation.
