Illinois Appellate Court
Civil Court
Sales Representative Act
Plaintiff appealed from a circuit court judgment in favor of the defendant on plaintiff’s claims for unpaid commissions brought under the Sales Representative Act. On appeal, plaintiff argued that the trial court incorrectly interpreted the relevant provisions of the Act. The appellate court affirmed, finding that the circuit court properly found that the liquidated damages clause in the agreement between the plaintiff and defendant was valid and enforceable and that the circuit court correctly concluded that the agreement comported with the requirements of the Act.
