Nos. 14-3557 et al. Cons.
Decision Date:

Federal District:
Petitions for Review, Order of Bd. of Immigration Appeals
Holding:
Petitions denied

Record contained sufficient evidence to support IJ’s removal order, where record showed that alien was citizen of Mexico, and that alien had committed crime involving moral turpitude by pleading guilty to burglary charge. Also, Bd. could properly reject alien’s asylum and withholding of removal applications, where alien’s proposed social group (i.e., individuals deported from U.S. who have family members with money to pay ransom to alien’s persecutors) is not cognizable as ground for protection, since group’s primary characteristic (i.e., ability to pay ransom) is not immutable characteristic. Ct. further rejected alien’s contention that his removal from U.S. would violate excessive fine provision of 8th Amendment.
