Dist. Ct. did not err in granting defendant-employer’s motion for summary judgment in plaintiff-truck drivers’ action alleging that defendant violated Fair Labor Standards Act (FLSA) by failing to pay plaintiffs overtime wages for working more than 40 hours per workweek. FLSA exempts from its overtime provisions employees who are subject to Secretary of Transportation’s jurisdiction under Motor Carrier Act, and record showed that plaintiffs were subject to said exemption, even though they performed “spotter” duties requiring only local truck driving hauls, since plaintiffs were subject to performing spotting duties that comprised one leg of continuous interstate journey for goods hauled by plaintiffs during their spotting duties. Fact that plaintiffs’ local hauls of goods represented one of several intermediate steps of hauling goods through interstate movements of goods did not require different result.
