Board did not commit legal error in denying petitioner’s application for discretionary cancellation of petitioner’s removal to Mexico, after finding that petitioner lacked good moral character based upon his D.U.I. conviction, as well as his convictions for operating motor vehicle without license, operating motor vehicle without insurance, and failing to install ignition interlock on his vehicle. Record also showed that petitioner used fake Social Security card to obtain employment. While I.J. erred in considering other conduct outside relevant 10-year period to determine petitioner's lack of good moral character, Board recognized I.J.’s error and reasonably based its determination on above misconduct that was within relevant 10-year period. Ct. rejected petitioner’s contention that Board made good moral character based solely on one D.U.I. conviction, and Board’s determination that petitioner’s evidence of rehabilitation was outweighed by petitioner’s criminal history was discretionary finding that was not reviewable by Ct. of Appeals. Fact that Board failed to mention petitioner’s proffered written statements about his character did not require remand, where content in letters were cumulative to other evidence that was considered in I.J.’s opinion.
