Saint Anthony Hospital v. Whitehorn

Circuit court reversed the trial court’s dismissal of count one of an action brought under section 1983, finding that the plaintiff, a hospital, alleged a viable right under federal law to have the Illinois Department of Healthcare and Family Services act to try to ensure timely payments from managed care organizations and that right was enforceable in a section 1983 action against the HFS director. The circuit court affirmed the trial court’s dismissal of additional counts of the complaint and declined to stay the proceedings in favor of arbitration. (WOOD, concurring and BRENNAN, dissenting)
