Defendant received a probation sentence that exceeded the Wisconsin statutory maximum for his offense, but was imprisoned for violating the conditions of his probation after the period of time when it should have concluded under the statute. Defendant filed a lawsuit against two sets of defendants who failed to correct the unlawful terms of his probation, alleging that they violated his due process rights, committed an unreasonable seizure, and showed deliberate indifference. The district court dismissed all of the claims and plaintiff appealed. The appellate court reversed dismissal of the claims premised on deliberate indifference explaining that the record did not compel a finding of qualified immunity and but otherwise affirmed the judgment of the trial court.
