U.S. v. Colon

Defendant was found guilty of engaging in a criminal enterprise and was sentenced to life in prison. Defendant filed a motion to reduce sentence under section 404 of the First Step Act of 2018. The district court denied the motion and defendant appealed. The Court of Appeals affirmed, finding that the trial court did not err when it concluded that defendant’s continuing criminal enterprise was not a “covered offense” under the Act and that defendant was ineligible for a sentence reduction.
