Plaintiff filed a lawsuit alleging trademark infringement against multiple e-commerce stores allegedly selling counterfeits of the plaintiff's products. The district court entered default judgment in favor of the plaintiff but denied plaintiff’s request for damages in the amount of the infringing sellers’ profits on the basis that while plaintiff provided evidence of the revenues earned from selling the counterfeit goods, it did not provide evidence of the profits. The Seventh Circuit reversed and remanded, explaining that the district court erred in its interpretation of the relevant trademark infringement law and finding that plaintiff met its burden.
