Federal 7th Circuit Court
Criminal Court
Civil Procedure
The Seventh Circuit considered the timeliness of defendant’s notice of appeal where it was not filed within the required time frame due to a typographical error in the mailing address, which resulted in the original notice of appeal being returned to the sender. The appellate court dismissed the appeal, finding that the address error precluded the court from finding that defendant satisfied the prison-mailbox rule to submit a timely appeal.
