Federal 7th Circuit Court
Criminal Court
Sentencing
Defendant pleaded guilty to trafficking of methamphetamines and federal prosecutors successfully sought to enhance his sentence based on a prior conviction. Defendant challenged the enhancement on appeal. The Seventh Circuit vacated and remanded for resentencing, finding that the district court failed to follow the provision of federal law that required the defendant to be given notice of which previous convictions the prosecutors intended to rely on for the requested enhancement.
