Plaintiff and her business, which provides guidance for individuals planning or making death and funeral arrangements filed a lawsuit seeking declaratory and injunctive relief against the State of Indiana alleging that enforcement of a statute relating to funeral homes against plaintiffs would violate the First Amendment. The district court issued a preliminary injunction enjoining enforcement of the statute against the plaintiffs and the state of Indiana appealed. The Seventh Circuit affirmed, finding that the plaintiffs were sufficiently likely to succeed on their claims and that the district court did not err in entering the injunction.
