Federal 7th Circuit Court
Civil Court
Eighth Amendment
Plaintiff suffered from serious mental health issues and while an inmate at a state correctional facility, spent eight years in segregation housing after he committed multiple disciplinary offenses. He filed a lawsuit against the prison’s health care provider and his mental health care providers alleging deliberate indifference to his mental health needs in violation of the Eighth Amendment. The district court granted summary judgment in favor of the defendants and plaintiff appealed. The Seventh Circuit noted that the case was “tragic,” but affirmed the district court by finding that the record did not contain an evidentiary basis from which a jury could find in the plaintiff’s favor. (EASTERBROOK and ROVNER, concurring)
