Qualified Immunity
Plaintiff, the estate of a deceased individual, filed a lawsuit after the decedent was shot and killed by law enforcement officers responding to a 911 call. The lawsuit alleged that the decedent’s Fourth Amendment rights were violated. The district court granted summary judgment in favor of the defendants and plaintiff appealed. The Seventh Circuit affirmed, finding that the officers were entitled to qualified immunity based on their belief that the decedent was threatening them with a firearm and that this belief was objectively reasonable under the facts of the case.
