Private Right of Action
The Seventh Circuit considered the question of whether a private individual or union may sue to enforce the provision of the Labor Management Reporting and Disclosure Act that prohibits a union or employer from spending money to promote a candidate for union office. The Seventh Circuit affirmed the judgment of the district court, finding that Congress did not intend private individuals to have a path to enforce that provision of the law through a private right of action.
