Federal 7th Circuit Court
Civil Court
Section 1983 Action
Plaintiff filed a lawsuit under 42 U.S.C. ยง 1983 alleging that his Fourth Amendment rights were violated after he was shot and injured by police officers. The district court dismissed the lawsuit after it found no constitutional violation under the totality of the circumstances and relied on qualified immunity in the alternative and plaintiff appealed. The Seventh Circuit affirmed, finding that the officers had probable cause to believe that plaintiff posed a threat of serious physical harm under the totality of the circumstances. (ST. EVE and JACKSON-AKIWUMI, concurring)
