Federal 7th Circuit Court
Civil Court
Racial Discrimination
Plaintiff filed a lawsuit alleging violations of Title VI of the Civil Rights Act and 42 U.S.C. § 1981, arguing that he was singled out for harsh treatment by a flight attendant and ultimately kicked off of the plane because of his race. The district court granted defendant’s motion to dismiss for failure to state a claim and plaintiff appealed. The Seventh Circuit affirmed, finding that there was no plausible allegation that plaintiff was discriminated against because the complaint contained nothing more than conclusory allegations and inferences.
