Defendant pleaded guilty to possessing controlled substances with intent to distribute, possessing a firearm as a felon, and possessing a firearm in furtherance of a drug-trafficking crime. On appeal, defendant argued that the district court erred when it allowed the prosecutor to make a late objection to the pre-sentence report or, in the alternative, that the 1:167 THC ration did not apply to edibles. The Seventh Circuit affirmed, explaining that it was within the district court’s discretion to permit the late objection and that defendant waived the latter argument. (ST. EVE and LEE, concurring)
