Defendant pleaded guilty to two counts related to child pornography, but reserved the right to contest the district court’s motion to suppress evidence on appeal. Defendant argued on appeal that a third-party’s search of files he saved on a cloud storage service violated his Fourth Amendment rights. The Seventh Circuit affirmed, noting that private searches are beyond the scope of the Fourth Amendment and that defendant assented to the company's terms of service which allowed the cloud storage service to review stored data to ensure that its service was being used lawfully.
