Federal 7th Circuit Court
Civil Court
Insurance Coverage
In an insurance coverage matter, the parties disputed whether the insured, who was injured in an automobile collision, could stack their medical payments, underinsured/uninsured automobile, and umbrella insurance policies. The district court granted summary judgment to the insurance company and plaintiffs appealed. The Seventh Circuit affirmed, finding that the language of the insured’s medical expenses, UM/UIM coverage, and other insurance prohibited stacking and the fact that the policy’s declaration page listed coverage limits twice did not mean that the policy authorized stacking or render the policy language ambiguous.
