Several media groups challenged the state of Indiana’s policy that restricted individuals to attend executions to only those individuals invited by the offender. The plaintiffs moved for a preliminary injunction to allow them to view executions, and the district court denied the motion. Plaintiffs appealed and the Seventh Circuit affirmed, explaining that its finding that executions have not historically been open to the press and the general public foreclosed any likelihood of success on the merits.
