Defendant, a licensed podiatrist, was found guilty of knowingly and intentionally dispensing a controlled substance outside of the usual course of professional practice and without a legitimate medical purpose and was sentenced to six months in prison and a monetary fine. On appeal, defendant challenged the sufficiency of the evidence, the district court’s evidentiary rulings, the denial of his motion for a mistrial, and the imposition of a fine at sentencing. The Seventh Circuit did not find any of defendant’s challenges persuasive and affirmed. (HAMILTON and ST. EVE, concurring)
