Federal 7th Circuit Court
Civil Court
Employee Compensation
Plaintiff filed a lawsuit against her employer for failing to pay her overtime and holiday wages in violation of the Fair Labor Standards Act and Wisconsin law. The district court granted the defendant’s motion for summary judgment and plaintiff appealed. The Seventh Circuit affirmed, finding that the employer correctly paid plaintiff overtime compensation at a rate exceeding 1.5 times her regular pay rate and it properly excluded holiday premiums from regular rate calculations under federal and state law.
