Fair Credit Reporting Act
Plaintiff filed a lawsuit alleging that the defendant violated the Fair Credit Reporting Act by reporting inaccurate or misleading information about her mortgage account when it reported that the mortgage account carried a past due balance and future balloon payment despite having been discharged in bankruptcy, a fact that defendant also included in the report. The district court dismissed the complaint for failure to allege a factual inaccuracy, reasoning that the accuracy of the information plaintiff complained about required a legal determination that defendant was not required to make. The Seventh Circuit agreed and affirmed. (KIRSCH and PRYOR, concurring)
