Federal 7th Circuit Court
Civil Court
Legal Malpractice; Fraud
Plaintiff filed a lawsuit complaining about the legal representation she received from the defendant because her attorney had a conflict of interest. The district court dismissed the complaint for failure to state a claim and plaintiff appealed. The Seventh Circuit noted that it was “troubled” by the attorney’s conduct but that it was required to affirm because plaintiff did not adequately plead harm as required to proceed on her legal malpractice claim. (HAMILTON and TAIBLESON, concurring)
