Plaintiff, who was assaulted by another inmate while on a probation hold in a county jail, filed a lawsuit under 42 U.S.C. ยง 1983 alleging that a deputy officer and the county jail were liable for failing to protect him The district court granted summary judgment in favor of the defendants and plaintiff appealed the entry of summary judgment against the officer. The Seventh Circuit affirmed, finding that the circumstances as known to the officer would not have caused a reasonable person to know that there was a substantial risk of serious harm to the plaintiff.
