Owners of condominium units sued Condominium Association seeking declaration that windows in one building were "limited common elements" and that Association lacked authority to assess cost of those windows being replaced as a common expense. Trial court properly granted summary judgment in favor of Plaintiffs, as Association lacked authority, under its Declaration and under Condominium Property Act, to assess those window improvements only to unit owners who benefited from the improvements, and Plaintiffs, whose units were located in a different building, did not so benefit.
