Plaintiff association and its law firms petitioned for Plaintiff's inclusion in a pending class action, concerned that the current class action plaintiff was not a suitable class representative. Class action settlement in underlying action for $89 million to the class and $19 million in fees to class counsel. Plaintiff law firms were paid $43,931 lodestar value for 142.8 hours of work on the case. Plaintiff was not entitled to additional attorney fees; although Plaintiff claimed that it did substantial work prior to filing of case, it failed to provide evidence as to factors such as time and labor required, difficulty of issues, skill required, and results obtained. Agreement of fee division does not comply with Rule 1.5(e) of Rules of Professional Conduct, and thus cannot be basis of recovery. (CUNNINGHAM and CONNORS, concurring.)
