Sentencing
Defendant was convicted, after bench trial, of first-degree murder and sentenced to 55 years. A defendant's status as a deportable alien should not be a factor in length of sentence for first-degree murder. When a first-degree murder sentence is otherwise appropriate and commensurate with seriousness of offense, it is inconsistent with ends of justice for deportable alien status to be cause to reduce sentence.
