Illinois Appellate Court
Civil Court
Abuse and Neglect
Court's finding that Respondent mother's two children were neglected minors due to injurious environment was against manifest weight of evidence. Evidence showed that Respondent's boyfriend, who mother left to care for minors while she went to doctor appointment, left minors unsupervised with bathwater running, and 3-year-old minor sustained second-degree burns to his face from scalding bath water. However, evidence showed that boyfriend immediately tended to child's injuries and notified Respondent mother, who arrived within 10 minutes; and no evidence that minors were left in boyfriend's care after incident nor that minors lived with him.
