Mechanics Lien Act
Section 5 of Mechanics Lien Act creates rights in derogation of common law, and thus procedural and technical requirements of Section 5 of Act must be strictly complied with for mechanic's lien to be valid. Failure to provide sworn contractor's statement, required by Section 5, bars recovery on a mechanic's lien claim.(McBRIDE and TAYLOR, concurring.)
