Illinois Appellate Court
Civil Court
Negligence
Plaintiffs were injured after being thrown to floor of CTA bus upon bus driver braking suddenly when cab cut into middle lane of traffic in front of bus from curb lane. Court properly granted summary judgment for Defendants. No evidence established any negligent conduct by Defendants, and there were no genuine issues of material fact. Any presumption of negligence was fully rebutted when Defendants showed that cause for sudden braking was cab driver's negligence in suddenly darting in front of bus. (ROCHFORD and REYES, concurring.)
