Illinois Appellate Court
Civil Court
Discovery
(Court opinion corrected 5/23/14.) Court entered order requiring that internet provider disclose personal information pursuant to Rule 224 petition for discovery before suit for computer fraud, abuse, and tampering, filed by Plaintiff, a computer systems company distributing adult entertainment content for a fee. Court lacked subject matter jurisdiction over Rule 224 petition for discovery, as Plaintiff's claim involved federal copyright law, over which federal courts have exclusive jurisdiction. Rule 224 petition cannot state with sufficient facts a cause of action against persons sought to be identified, as it fails to apprise court that further discovery would be necessary to form reasonable belief as to responsible persons.(WELCH and CHAPMAN, concurring.)
