Illinois Appellate Court
Criminal Court
Battery
Defendant was convicted of aggravated battery, for committing battery upon another inmate in a common area for inmates while both were incarcerated at County Jail. Defendant was properly convicted of aggravated battery on the theory that the area inside the County Jail was “public property” within the meaning of section 12-3.05(c) of the Criminal Code of 2012. Even though place where battery occurred was not open to the public, court properly took judicial notice that county jail was "public property" and obtained necessary information.
