Willis v. The Macon County State’s Attorney

(Court opinion corrected 12/7/16.) Petitioner appealed revocation of his FOID card by State Police. After hearing, circuit court granted Petitioner's petition, and court ordered State Police to issue FOID card to Petitioner. Under 2013 amendments to FOID Act, a circuit court is prohibited from granting a Petitioner relief under Section 10 of FOID Act when he or she is prohibited from possessing a firearm under federal law. As State Police revoked Petitioner's FOID card after the 2013 amendments to FOID Act, the 2013 amendments apply to Petitioner. (HARRIS and APPLETON, concurring.)
