Illinois Appellate Court
Civil Court
Discovery
Plaintiffs filed suit alleging that School Board and elementary school failed to properly supervise students during recess, such that minor plaintiffs and minor defendant engaged in sexual conduct in school bathroom. Court did not abuse its discretion in ordering that depositions proceed in the manner instructed, in appointing mental health physicians to determine whether minor plaintiffs could sit for depositions and to provide recommendations. Trial courts have discretion to supervise discovery process, and to determine whether justice requires a protective order and appropriate parameters of order. (GORDON and REYES, concurring.)
