Illinois Appellate Court
Criminal Court
Guilty Pleas
Court denied Defendant's motion to withdraw his plea to aggravated robbery. Although court erred in failing to inquire into Defendant's ineffective-assistance claim in a neutral and nonadversarial proceeding, error was harmless. At guilty plea hearing, Defendant was told 6 times that he was subject to Class X sentencing, and was told 3 times that he faced a mandatory minimum sentence of 6 years; and was told that offense was nonprobationable, and Defendant said that he understood. Any prejudice resulting from counsel's alleged incorrect advice was cured by court's admonishments and Defendant's expressed understanding. (BIRKETT and SPENCE, concurring.)
